These Terms are between you and Miguel Herrero Burgos, Spain, the operator of TodayNYC. They govern your use of todaynyc.app, the TodayNYC web planner and AI chat, and the TodayNYC plugin and read-only MCP planning service. By using a TodayNYC service, you agree to these Terms. If you do not agree, do not use the service. The Privacy Policy explains how information is handled.
TodayNYC provides informational, curated planning suggestions for New York City. The plugin currently offers a limited, read-only three-hour Manhattan planning experience. It does not make reservations, buy or sell tickets, process payments, provide transportation, or act as an agent for a venue or user.
Plans may include published hours, addresses, walking estimates, external source links, and catalog freshness information. They are planning aids, not guarantees of live opening, admission, inventory, accessibility, travel time, weather, safety, or suitability. Always confirm important details directly with the venue, operator, or official source before relying on them.
You are responsible for your decisions, travel, purchases made with third parties, compliance with local rules, and the information you submit. Do not provide passwords, payment-card data, government identifiers, medical information, other sensitive personal information, or an exact private address. Adults supervising children remain responsible for their safety and use of the service.
You may use TodayNYC for lawful personal or business planning. You may not attempt to disrupt or overload the service, bypass its safeguards or limits, probe it for unauthorized access, introduce malicious code, scrape it at a volume that impairs service, misrepresent TodayNYC output as a live guarantee, or use the service in violation of another person’s rights or applicable law.
TodayNYC links to venues, maps, transport providers, public authorities, and other third parties. Their content, availability, prices, transactions, terms, and privacy practices are controlled by them, not TodayNYC. Use of the plugin through an OpenAI product is also subject to the terms of that OpenAI product. A link or plan inclusion does not mean TodayNYC controls or guarantees the third party.
TodayNYC and its original branding, presentation, software, and curated materials are protected by applicable intellectual-property laws. Subject to these Terms, TodayNYC gives you a limited, revocable, non-exclusive, non-transferable right to use the service for its intended purpose. Third-party names, information, and materials remain the property of their respective owners.
TodayNYC may update, restrict, suspend, or discontinue part or all of the service, including catalog coverage and plugin capabilities. Access may be limited to protect security, comply with law, prevent abuse, or maintain the service. TodayNYC may update these Terms; continued use after an updated effective date means you accept the revised Terms.
To the extent permitted by applicable law, TodayNYC is provided “as is” and “as available,” without warranties of accuracy, completeness, uninterrupted operation, fitness for a particular purpose, merchantability, non-infringement, or live availability. Nothing in these Terms excludes warranties or consumer rights that applicable law does not allow to be excluded.
To the extent permitted by applicable law, TodayNYC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, opportunities, or goodwill arising from use of or inability to use the service or from reliance on third-party information. TodayNYC’s aggregate liability for a claim relating to the service will not exceed the greater of the amount you paid TodayNYC for the service during the twelve months before the claim or 100 US dollars. These limits do not apply where applicable law prohibits them.

These Terms are governed by the laws of Spain, without depriving consumers of mandatory protections granted by the law of their country of residence. Any dispute will be handled by the courts determined under applicable law. If you are a consumer in the European Union, nothing in these Terms limits your mandatory consumer rights or your right to bring a claim before the courts available to you under consumer law.
